Welcome to MoonLog (moonlog.co). These Terms of Service govern your access to and use of the MoonLog website, application, and services. Please read these terms carefully before accessing or using MoonLog. By accessing or using MoonLog, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By accessing, browsing, or using MoonLog in any way, including but not limited to viewing content, creating an account, or making a purchase, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must immediately cease access to MoonLog and all its services.

MoonLog reserves the right to modify these Terms of Service at any time. Your continued use of MoonLog following any modifications constitutes your acceptance of the revised terms. We encourage you to review these terms periodically for updates.

2. Description of Service

MoonLog is a digital platform that provides lunar tracking, moon phase information, astrological insights, and related informational and entertainment content. The service includes features such as daily moon phase readings, personalized lunar reports, astronomical data, and educational materials related to lunar cycles and their cultural significance.

MoonLog offers both free and subscription-based access to its services. The scope and features of our service may be expanded, modified, or discontinued at our sole discretion. We may introduce new features, retire existing ones, or change the functionality of the platform without prior notice.

3. User Accounts

3.1 Account Creation

To access certain features of MoonLog, you may be required to create an account. You agree to provide accurate, complete, and current information when creating your account. You are responsible for maintaining the confidentiality of your account credentials, including your password and email address.

3.2 Account Responsibility

You are solely responsible for all activities that occur under your account. You agree to notify MoonLog immediately of any unauthorized access to or use of your account. MoonLog shall not be liable for any loss or damage arising from your failure to protect your account information.

3.3 Account Eligibility

You must be at least eighteen (18) years of age to create an account and use MoonLog. By creating an account, you represent and warrant that you are at least eighteen years old and have the legal capacity to enter into this agreement.

3.4 Account Termination

MoonLog reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these terms, misuse of the service, or engagement in illegal activities.

4. Payment Terms

4.1 Subscription Pricing

MoonLog offers subscription access at nine dollars and ninety-nine cents ($9.99) per month. Additional pricing tiers and special offers may be available and will be clearly displayed at the time of purchase. All prices are in United States dollars unless otherwise specified.

4.2 Billing

Your subscription will be automatically billed monthly on the same day of the month that you initiated your subscription. If your billing date falls on a date that does not exist in a particular month (such as the 31st), billing will occur on the last day of that month. You authorize MoonLog to charge your payment method on file for all recurring subscription fees.

4.3 Payment Methods

MoonLog accepts various payment methods, including credit cards and other electronic payment options. By providing your payment information, you represent and warrant that you are authorized to use that payment method and that all information provided is accurate and current.

4.4 Subscription Renewal

Your subscription will automatically renew each billing period unless you cancel your subscription. You acknowledge that your account will be charged on each renewal date until you cancel your subscription. It is your responsibility to manage your subscription settings and cancel if you no longer wish to be charged.

4.5 Cancellation Policy

You may cancel your subscription at any time by logging into your MoonLog account, navigating to your account settings, and selecting the cancellation option. Alternatively, you may contact our customer support team to request cancellation. Your cancellation will take effect at the end of your current billing period. You will retain access to premium features through the end of your paid billing cycle.

Cancellation requests must be submitted prior to your next billing date to avoid being charged for the following month. MoonLog is not responsible for charges incurred if cancellation requests are submitted after your billing date.

4.6 Refund Policy

MoonLog operates on a strict no-refund policy for subscription fees that have already been charged. Since MoonLog provides immediate access to digital content and services upon purchase, subscriptions are non-refundable. This applies even if you cancel your subscription immediately after purchase.

If you believe a charge was made in error or that you were incorrectly billed, you must contact MoonLog customer support within thirty (30) days of the charge. MoonLog will investigate disputed charges and may issue a refund or credit at its sole discretion if the charge was determined to be erroneous.

Chargebacks or disputes filed directly with your payment provider may result in immediate account termination and legal action by MoonLog.

4.7 Price Changes

MoonLog reserves the right to modify subscription pricing at any time. If we increase our subscription price, we will provide you with at least thirty (30) days notice. Your continued use of MoonLog following the price increase notification constitutes your acceptance of the new pricing. If you do not agree to the new price, you may cancel your subscription before the price change takes effect.

5. Intellectual Property

5.1 MoonLog Intellectual Property

All content, materials, designs, text, graphics, images, videos, audio, software, code, and other intellectual property available on or through MoonLog, including but not limited to the website design, layout, arrangement, and all original works created by MoonLog, are the exclusive property of MoonLog or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

Subject to your compliance with these Terms of Service, MoonLog grants you a limited, non-exclusive, non-transferable, revocable license to access and use MoonLog for your personal, non-commercial purposes. This license does not permit you to sell, resell, rent, lease, transfer, assign, or otherwise commercially exploit MoonLog or its content.

5.3 Restrictions on Use

You agree not to copy, reproduce, modify, distribute, transmit, perform, display, create derivative works from, or in any way exploit the intellectual property of MoonLog without prior written permission. Prohibited activities include, but are not limited to, framing, scraping, data mining, screen capture for distribution, and the use of any automated tools to harvest content.

5.4 User-Generated Content

If MoonLog allows you to submit, upload, or otherwise provide content (including but not limited to text, images, or personal notes), you grant MoonLog a worldwide, perpetual, royalty-free, non-exclusive license to use, reproduce, modify, display, and distribute such content for operational and service improvement purposes. You represent and warrant that you own all rights to any content you submit and that such content does not infringe upon any third-party intellectual property rights.

5.5 Trademark

MoonLog, the MoonLog logo, and all associated names, logos, and brand identifiers are trademarks of MoonLog. You agree not to use these trademarks without prior written permission from MoonLog.

6. Limitation of Liability

6.1 Disclaimer of Damages

To the maximum extent permitted by applicable law, MoonLog and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of MoonLog, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if MoonLog has been advised of the possibility of such damages.

6.2 Limitation Cap

In no event shall the total liability of MoonLog and its officers, directors, employees, agents, and licensors for all claims related to MoonLog exceed the amount paid by you to MoonLog in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

6.3 Basis of Disclaimer

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, the above limitation shall be modified to the maximum extent permitted by law.

7. Disclaimer and Informational Use

7.1 Entertainment and Informational Purposes

MoonLog and all content, features, and information provided through MoonLog, including but not limited to moon phase data, astrological readings, lunar reports, and related materials, are provided strictly for entertainment and informational purposes only. MoonLog does not provide professional, medical, financial, legal, psychological, or other licensed professional services or advice.

7.2 No Professional Advice

Content on MoonLog should not be construed, interpreted, or relied upon as professional advice of any kind. MoonLog makes no representations or warranties that the information provided is suitable for any particular purpose or that it will produce any specific result. You acknowledge and agree that any reliance on MoonLog content is entirely at your own risk.

7.3 Not a Substitute for Professional Services

MoonLog content is not a substitute for professional medical, psychiatric, psychological, financial, legal, or other licensed professional services. If you require professional advice or services of any kind, you should consult with a qualified, licensed professional in the appropriate field. Failure to seek appropriate professional assistance based on reliance on MoonLog content could result in serious harm to your health, finances, legal standing, or well-being.
